Terms of Sale and Use
These terms apply when you use this website or buy from Felix Assouline Cigars (“we”, “us”). By placing an order or joining The Jamastrán Society you agree to them.
1. Age and eligibility
You must be 21 or older to enter this site, buy from us, join the Society or subscribe to our emails. By using the site you confirm that you are. We verify age at checkout. We may cancel any order where we cannot verify age, and we report attempted purchases by minors where the law requires.
2. Orders and pricing
Prices are in US dollars. Applicable sales and tobacco taxes and delivery charges are shown before you pay. Your order is an offer to buy; it is accepted when we confirm it by email. We may refuse or cancel an order, for example if a product is unavailable, a price was shown in error, or delivery to your address is not permitted. If we cancel after charging you, we refund you in full.
Limited releases, such as EGO Black, are allocated in limited quantities. We may limit the number of boxes per customer.
3. Delivery
We deliver only within the United States and only where the law permits the delivery of tobacco products. Delivery times are estimates. Risk passes to you on delivery. See Shipping and returns.
4. Returns and refunds
Every order carries our 30-day money-back guarantee. The guarantee and how to return an order are set out in Shipping and returns. Nothing in these terms limits rights you have under consumer protection law.
5. The Jamastrán Society: automatic renewal
Membership renews automatically. When you join, you authorize us to charge the payment card you provide the membership price shown for your tier, plus any applicable tax, when you join and again on every delivery date (every month, or every two months, as you choose) until you cancel.
- Cancel any time, online: at Manage membership. Cancellation takes effect immediately and stops all future charges and deliveries. Deliveries already charged will still ship.
- Changes: you may change tier from the same page; the new price applies from your next delivery. Requests to skip a delivery are confirmed by email.
- Price changes: we will email you at least 30 days before any change to your membership price, and you can cancel before it takes effect.
- Confirmation: we email you a confirmation of these terms, including how to cancel, when you join.
- Failed payments: if a renewal payment fails we will email you, and may pause your membership until it is resolved.
- Selection: cigars in each delivery are chosen by the house and may vary in line and size.
6. Promotions
Promotion codes have no cash value, apply to eligible products only, cannot be combined unless stated, and may be withdrawn at any time. Welcome codes are limited to one per customer.
7. Health warning
WARNING: Cigar smoking can cause cancers of the mouth and throat, even if you do not inhale. Tobacco products are for adults only.
8. Using this site
All content on this site, including the Felix Assouline and Omega Tabacos names, crest, bands and photographs, belongs to us or our licensors. You may view and share pages for personal use, but not copy or reuse them commercially without our permission. Do not misuse the site, for example by trying to access its server areas or by submitting false information.
9. Liability
To the extent the law allows, our total liability to you for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential losses. Nothing in these terms excludes liability that cannot be excluded by law.
10. Governing law
These terms are governed by the laws of the State of [State of incorporation], without regard to its conflict-of-law rules, except where the law of your state of residence requires otherwise.
